AMENDED MEMORANDUM OPINION

GRADY, District Judge.

This is an action under § 2 of the Sherman Act; § 3(3) of the Illinois Anti-Trust Act; 42 U.S.C. § 1983; Article I, § 2 of the Illinois Constitution; and for interference with prospective business advantage. Defendants have brought this motion to dismiss, claiming that under Parker v. Brown, 317 U.S. 341, 63 S.Ct. 307, 87 L.Ed. 315 (1943), they are immune from liability for the challenged actions. 1 Because defendants submitted materials outside of the pleadings with their motion, under Rule 12 we must treat this as a motion for summary…
