MEMORANDUM OPINION
GRADY, District Judge.
This is an action brought under 42 U.S.C. § 1983, the federal antitrust laws, various state laws and various common law tort theories. Pending before the court are defendants’ motions to dismiss and for attorneys’ fees relating to a previous motion for disqualification. We deny the motion to dismiss, but with leave to amend and with out prejudice as to certain parts. We also deny the motion for attorneys’ fees.
