The following opinion is in lieu of our opinion announced on September 28, 1959.

This case is an appeal from a judgment of the court below permanently enjoining and abating a common nuisance and padlocking all the occupied buildings on Lots 15 and 16, Block 4, Lubbock, Texas, in a suit for the suppression of a public nuisance by means of a civil remedy exercised through the police power of the State.
