This is an action in replevin brought by John S. Mahar, hereinafter referred to as plaintiff, to recover a G. M. C. truck from the defendant, Charley White, which was sold to the defendant by the plaintiff’s agent, D. R. Manzer. At the close of plaintiff’s testimony, defendant demurred to the evidence, and thereupon judgment was rendered for the defendant upon the evidence submitted, and plaintiff appeals.
