This appeal involves a four-dimensional interface between (1) the legislative branch of Maine’s government, which over time enacted the series of statutes reproduced in the appendix; (2) the judicial branch, particularly the Maine Supreme Judicial Court (SJC), which declared certain of those statutes unconstitutional as applied; (3) the executive branch, in the persons of Maine’s governor, attorney general and the ranking administrators of the state’s penal system (including respondent Mark C.
