COGAN, District Judge.

Plaintiffs Waclaw Sobczak and Radoslaw Gardocki, on behalf of themselves and others similarly situated, bring this action alleging that defendants through a common policy or plan misclassified the type of work their employees performed in order to pay the employees lower prevailing wages and thereby violated the Fair Labor Standards Act of 1938 (29 U.S.C. § 201, et seq.)
