In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Queens County (Dye, J.), dated July 9, 1999, which denied his motion for summary judgment dismissing the complaint.

Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed.

The plaintiff allegedly was injured when she was knocked down by a panhandler who was opening the door to the defendant’s restaurant. In his motion for summary judgment the defendant made a prima facie showing of entitlement to judgment as a matter of law.…
