McCORMICK, Circuit Judge.
The defendant in error brought this action against the plaintiffs in error in the circuit court for the Western district of Texas. On May 7, 1897, it presented its first amended original petition, which, by the practice in that stare, takes the place of its former pleading. This amendment states the'plaintiff’s case as follows:
