OPINION AND ORDER
BECHTLE, District Judge.
Plaintiffs bring this civil rights action under 42 United States Code, § 1983 for damages of Eight Hundred Thirty Dollars ($830.00), an amount equal to the cost of sending their minor son to a private non-sectarian school for one semester. Jurisdiction is claimed under 28 U.S.C., § 1343. The plaintiffs are the parents and natural guardians of B. Jay Biehrest, who was six (6) years old on March 27, 1971. They live in Philadelphia, Pennsylvania, are homeowners and pay taxes that, among other things, supports the public school system in Philadelphia. They…
