Sam Thompson, the relator, owns a farm in the town of Albion, Jackson county, Wisconsin. On the 29th day of June, 1929, he filed with the town clerk of the town of Albion a petition for the laying out of a highway therein described. This petition was signed by himself and more than six other resident freeholders, and was sufficient to confer the power and impose the duty on the town board to take the statutory proceedings and make their determination upon such petition.
