On May 29, 1992, while Diane Wisner was driving her mother, Marie Boyd, home from the grocery store, Ms. Wis-ner was arrested by members of the Carroll County Narcotics Task Force (the “Task Force”) for possession of cocaine with intent to distribute. Incident to Ms. Wisner’s arrest, and pursuant to Maryland Code (1957, 1996 Repl.Vol.) Article 27, § 297 (“the Maryland drug forfeiture law” or “the statute”), the Task Force seized the vehicle Ms. Wisner had been driving, which was owned by Ms. Boyd and her husband, Paul Boyd, appellants.
