Currently pending before the Court is Defendant Washington Mutual’s Motion for Summary Judgment (Rec.Doc. No. 18). For the following reasons, the motion is GRANTED.
I. BACKGROUND:
This dispute arises out of the use of insurance proceeds paid to compensate the Plaintiff and his former spouse April Owens DiBenedetto for losses arising out of damage to their marital home and personal property therein as a result of Hurricane Katrina.
