Error to Calhoun; Smith, J. Assumpsit by Gerald Carver against school district No. 6 of Battle Creek township, upon a teacher’s contract. From a judgment for defendant, plaintiff brings error.

The plaintiff, on the 11th of September, 1893, entered into a contract with defendant, reading as follows:
“It is hereby contracted and agreed between the district board of school district No. 6, in the township of Battle Creek, county of Calhoun, and State of Michigan, and Gerald Carver, a legally-qualified teacher, in said township, that the said Gerald Carver shall teach the school of said district for the term of nine months commencing on the 11th day of September, 1893; and the said Gerald Carver agrees faithfully to keep a correct list of the pupils, and the age of each, attending…
