The .plaintiff in error, John E. Hourigan, was defendant in the court below,-and defendant in error, the Home State Bank, was plaintiff in the court below. The parties will be hereinafter designated as they were in the court below. The plaintiff brought action in the county court of Comanche county against John E. Hourigan to recover the value of certain cattle alleged to have been converted by Hourigan.
