PLEASANTS, Chief Justice.

The appellee, Willie Coleman, by his next friend brought this suit against appellant to recover damages for personal injuries alleged to have been caused by the negligence of appellant’s servants. The cause of action alleged in the petition is, in substance, that appellee, k child of seven years of age, was run over and injured by a train of cars on appellant’s railroad; that at the time the injury occurred he was walking upon appellant’s track at a place where said track was commonly used by the public as a passage way and appellant’s agents and servants operating…
