MEMORANDUM ORDER
MARY PAT THYNGE, United States Magistrate Judge.
I. INTRODUCTION
In this case, the court now considers defendant Horace Mann Insurance’s (“Horace Mann”) motion to dismiss pursuant to Fed.R.CivP. 12(b)(6) and 12(b)(7), and, in the alternative, its motion for a more definitive statement, under Fed. R.Civ.P. 12(e). 1 The parties completed briefing on these issues on July 22, 2010. 2 For the reasons stated below, the motions are denied.
