In a negligence action to recover damages for personal injuries, etc,, plaintiffs and defendants Sheridan Maintenance Corporation and Albert Rhodie appeal from a judgment of the Supreme Court, Queens County, entered June 23, 1970, in favor of defendants Max Kausch and Mister Softee Eastern New York Division, Inc., against plaintiffs, upon the trial court’s dismissal of the complaint as against said defendants at the end of plaintiffs’ ease.
