I. INTRODUCTION

On November 7, 2003, Tonkubo Shomide (“plaintiff’) filed a pro se complaint alleging racial discrimination under Title VII of the Civil Rights Act of 1964. Plaintiff was given leave to file his amended complaint on March 22, 2007. Plaintiff alleges that ILC Dover, Inc., now known as ILC Dover, L.P. (“defendant”), discriminated against him when it terminated his employment on account of his race, color, and national origin.
