This action is a controversy between parties who were-husband and wife prior to their divorce in 1936, and who seek to determine their rights and obligations under a “separation agree*511ment” which they executed on May 1, 1933. This same separation agreement was considered by this court in an earlier case involving the same parties (Petty v. Petty, 147 Kan. 342, 76 P. 2d 850).

In the instant case defendant’s motion for judgment on the pleadings was sustained by order of the district court and plaintiff has appealed.
