MEMORANDUM OPINION AND ORDER

ARRAJ, District Judge.

In this diversity case plaintiff seeks to hold defendant liable under an insurance policy for certain damage to a gas well. Plaintiff, Noyes Supervision, Inc., is a Colorado corporation and defendant Canadian Indemnity Co. is the Canadian insurance company which issued the policy involved in this action. Defendant filed a Motion for Summary Judgment pursuant to Rule 56, Fed.R.Civ.P., on the grounds that plaintiff breached the notice condition of the policy and that the loss is not covered because of certain exclusions contained in the policy.…
