The object of this action, which is instituted by the testamentary executor of the late George B. Milligan, is threefold : He seeks, first, to obtain the partition, in kind or otherwise, *354of a sugar plantation, slaves, &c. which, he alleges, belong for one third to the succession of the deceased, the other two thirds belonging to the defendant. 2d.
