MEMORANDUM AND ORDER

ROGERS, District Judge.

This is an action to set aside or modify three civil investigative demands (“CIDs”) issued by respondent as part of an investigation of possible Sherman Act violations in the sale of used automotive parts. Two motions are currently pending before the court: 1) a motion to dismiss the petition; * and 2) a motion for a protective order barring the deposition of the person responsible for the preparation of the CIDs, respondent Mr. David Foster.
