HORN, Judge.
The above-captioned case comes before the court on the defendant’s motion for dismissal pursuant to Rules 12(b)(1) and 12(b)(4) of the Rules of the United States Court of Federal Claims (RCFC) for lack of subject matter jurisdiction and failure to state a claim upon which relief can be granted, respectively.
