ANR Pipeline Company (ANR), appel-lee, filed a declaratory judgment action against appellants, W.A. Moncrief, Jr., individually and as independent co-executor of the estate of W.A. Moncrief, and Charles B. Moncrief, as independent co-executor of the estate of W.A. Moncrief (the Moncriefs). ANR requested the trial court to declare the rights and obligations of the parties under a “take-or-pay” settlement agreement.
