McQUADE, Justice.
Respondent, Idaho Employment Security Agency, is herein sometimes designated as the Agency, and the Industrial Accident Board as the Board.
The facts are uncontroverted. Otis Byrd has been a licensed barber since 1927 and has owned a barber shop as an individual or partner since that year. He has operated a barber shop at his present location for almost thirteen years. This shop houses three barber chairs. The shop is licensed to Byrd by the Idaho Department of Law Enforcement.
