Plaintiff, a distributor of photo-plays, entered into a contract with defendant, an exhibitor of such plays, whereby plaintiff agreed to deliver to defendant the films of six certain photo-plays to be thereafter produced, and to license defendant to exhibit each of them in turn for a period of one week, and defendant agreed to pay therefor the sum of three hundred dollars for each such picture, payable one week in advance of the exhibition thereof.
