Pending is the petitioner’s request (Doc. # 1) to vacate, correct, or set aside his sentence under 28 U.S.C. § 2255. The Government has responded (Doc.# 2). 1. Petitioner, Ronnie Joe Benson, was indicted by a Grand Jury for the Eastern District of Arkansas on November 12, 1996. On December 13, 1996, a Superseding Indictment was returned by the Grand Jury and the case went to trial on July 15, 1997.
