OPINION OF THE COURT

On December 6, 2012, the police executed a search warrant and recovered a loaded firearm from defendant’s bedroom. Defendant was arrested and charged with criminal possession of a weapon in the fourth degree and related charges. On March 18, 2013, defendant was indicted and charged with criminal possession of a weapon in the second degree and related charges based on the recovery of said firearm.
