— Appeal by the defendant from a judgment of the Supreme Court, Kings County (Moskowitz, J.), rendered January 10, 1989, convicting him of grand larceny in the first degree, conspiracy in the fourth *933degree, offering a false instrument for filing in the first degree (37 counts) and falsifying business records in the first degree (26 counts), upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, on the law, by vacating the provision of the sentence which requires the defendant to make restitution in the amount of $16,000,000; as so modified, the judgment is affirmed,…
