OPINION AND ORDER
VAN ANTWERPEN, District Judge.
This matter is before the court on defendants’ motion for summary judgment pursuant to Federal Rule of Civil Procedure 56(c). Jurisdiction is based on diversify. 28 U.S.C. § 1332.. On February 3, 1993, plaintiff, Catherine M. Beaver, filed a complaint in the Philadelphia Court of Common Pleas commencing a wrongful death action and a survival action as the administratrix for the estate of Wayne Leon Beaver.
