Defendant was tried by jury and found guilty of breaking and entering in the nighttime with the intent to commit larceny, in violation of 13 V.S.A. § 1201. Motions for acquittal at the conclusion of the case for the prosecution, and again at the close of all the evidence, on the grounds that the evidence was not sufficient to support a guilty verdict, were denied by the trial court. Defendant instituted a timely appeal to this Court from the judgment of conviction against him.
