¶ 1. In this appeal of his conviction for driving under the influence (DUI), defendant alleges that the trial court made both factual and legal errors. First, he argues that several important factual findings by the court were clearly erroneous. Next, he argues that the court should have suppressed all evidence following his arrest as fruit of the poisonous tree because the trooper who arrested him did so without probable cause.
