RULING ON PLAINTIFF’S MOTION TO REMAND AND ON DEFENDANTS’ MOTION TO TRANSFER

CLARIE, Chief Judge.

The plaintiff has moved to remand this case to the state court on the grounds that the removal was untimely and that requisite diversity of citizenship does not exist. Three of the defendants oppose such action, and have moved for an order transferring the case to the Eastern District of New York on the grounds that the action could have been brought there in the first place and that the interest of justice and the convenience of the parties would be best served thereby.
