HEANEY, Circuit Judge.

The appellant was convicted by a jury on three counts of violating 18 U.S.C. § 1163, 1 by converting or misapplying funds from the Community Action Program on the Fort Berthold Indian Reservation. He and seven other defendants were acquitted on numerous additional counts and on a general count of conspiracy.
