In Yankee Atomic Electric Co. v. United States, 536 F.3d 1268 (Fed.Cir.2008) (‘‘Yankee II ”) the United States Court of Appeals for the Federal Circuit affirmed-in-part and reversed-in-part this court’s findings and conclusions in Yankee Atomic Electric Co. v. United States, 73 Fed.Cl. 249 (2006) (“Yankee I”). The Court remanded the case, requiring a reassessment of causation using the 1987 Annual Capacity Report (“ACR”) acceptance rate for the reraeking and dry storage costs awarded to plaintiffs.
