WHEELER, Judge.
This case is before the Court on remand from the United States Court of Appeals for the Federal Circuit. See Carolina Power & Light Co. v. United States, 573 F.3d 1271 (Fed.Cir.2009). Plaintiffs Carolina Power & Light Company and Florida Power Corporation (collectively “Progress Energy”) own five nuclear reactors at four power plants in North Carolina, South Carolina, and Florida.
