CLIFFORD, District Judge.

This matter comes before me upon the Petition of Frederick Gerrish for Writ of Habeas Corpus in which he alleges that he is restrained in thé custody of Willard Pease, Warden of Knox County Jail at Rockland, Maine.

An original petition was received in this Court on April 26, 1951. Three days later a letter was received from petitioner stating that he had secured counsel to represent him, and believed that his attorney desired to discontinue the case for about ten days.
