This is an appeal from a judgment for the sum of $2,000 recovered by appellee against appellant. The declaration consists of two counts. In the first count it is averred, in substance, that March 5, 1903, the defendant was engaged in the business of manufacturing heavy machinery at, to-wit, 300 W.
