By this appeal, the defendant, Kee & Chapell Dairy Company, seeks to reverse a judgment for $3,500 which the plaintiff, Myrtle Bost, recovered, based upon a verdict of a jury finding the issues in her favor.

The declaration consists of one count: It is alleged therein that the defendant was engaged in the dairy or milk business and, in connection therewith, used a large number of glass bottles, and certain machinery and appliances for cleansing the bottles; that after the bottles were cleansed, they were filled with milk and cream for distribution among the defendant’s customers, among whom…
