Head, Justice.
(After stating the foregoing facts.) A motion was made to dismiss the writ of error on the ground that the only persons made defendants in error in the case in this court are Harrison and Long, although it appears that there were other defendants in the petition filed in the trial court, and these other defendants, and particularly Mrs. Thelma Pace King, are interested in sustaining the judgment of the lower court, and are necessary parties to the bill of exceptions.
