On June 22, 1988, AM International, Inc. (AMI), filed this action to recover costs incurred in removing environmentally hazardous substances from a site in Euclid, Ohio. AMI sought compensation pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA), 42 U.S.C. § 9601 et seq., and pursuant to pendent state law causes of action for unjust enrichment and quasi-contractual damages.
