RULING ON DEFENDANTS’ MOTION TO DISMISS

POLOZOLA, District Judge.

This matter is before the Court on a motion to dismiss filed by the defendants. For the reasons which follow, the motion is granted.

FACTS AND PROCEDURAL HISTORY

The plaintiffs, Herman Wayne Sharp, Jr. and the Sharp Land Company (collectively “the Sharps”), individually own adjoining tracts of land in West Baton Rouge Parish, Louisiana.
