SMITH, Judge.
On 13 November 1993, the victim was sleeping in her home, along with her three children aged 10,11 and 17 in North Wilkesboro, North Carolina. In the early morning hours she was awakened by a noise in her living room. She looked down the hallway and could see figures going back and forth in the living room. She thought it was her oldest son, as he had the habit of getting out of bed and watching T.V. late at night. The victim called out to her son several times to tell him to go back to bed.
