The opinion of the court issued on February 15, 2002, 283 F.3d 322, is withdrawn and the following is substituted.

David S. Morgan appeals his conviction for possessing migratory game birds exceeding the daily bag limit in violation of the Migratory Bird Treaty Act (MBTA), 16 U.S.C. § 703 (2000) and its attendant regulations. Morgan argues that his conviction should be reversed because the misdemeanor with which he was charged is not a strict liability offense and that he did not intend to commit the crime.
