This action is brought upon an alleged contract claimed to have been made on the twenty-seventh day of February, 1883, between the parties, by which the defendant agreed to and did sell to plaintiffs certain white pine lumber. The contract declared upon is as follows: '

“ This agreement, made this, the twenty-seventh day of February, 1.883,between the Pinconning Manufacturing Company, of Pinconning, Michigan, of the first part, and A. M. Switzer & Company, of Bay City, Michigan, of the second part, witnesseth : The said party of the first part hereby agrees to sell and does sell to said party…
