delivered the opinion of the court.

This suit was instituted by Marjorie Stare, appellee, against Andrew Yayda, appellant, to recover for injuries alleged to have been sustained by appellee by reason of the negligence of appellant in driving a taxicab over her and breaking her limb. The injury complained of was occasioned December 25, 1921.

The suit was commenced September 7, 1922. Appellant by his attorney filed the general issue in September, 1922. On December 4,1922, counsel for appellant asked to withdraw from the case and on January 13, 1923, the motion was…
