Plaintiff brought an action on the case against the defendant to recover $1,500 which he claimed he had earned as a real estate broker in selling a piece of real estate and out of which he had been defrauded by the defendant. Plaintiff filed his declaration on June 26, 1925, and the defendant on July 7, 1925, filed his plea of not guilty. On May 27, 1926, it appears from the record the cause was called for trial; that the plaintiff and his attorney appeared but that the defendant did not appear nor was he represented by counsel.
