The defendant, George W. Eay, was indicted by the Grand Jury of Oaldwell County for the attempt to ravish one Jennie Wyatt, (a colored girl) in the year 1868. The defendant was not arrested 6n the capias issued on the indictment until 1872. A trial was had at tbe June term of tbe Oaldwell'Circuit Oourt, and shortly after tbe arrest, resulting in a verdict of guilty. Tlie evidence was amply sufficient to sustain tbe charge, and no just ground of complaint can be urged against tbe instructions, for tbey, as a whole, presented tbe case very fairly to tbe jury.
