Appeal from St. Louis Criminal Court. — Rots. G. S. Van Wagoner, Judge. The defendant, appellant here, was indicted at the October term, 1885, of the St. Louis criminal court, for the murder, in the first degree, of Charles Arthur Preller. The indictment contained three counts charging the crime to have been committed on April 5, 1885, in the city of St. Louis: (1) By chloroforming the deceased until unconscious, and then choking and strangling him to death.

The defendant was tried in the St. Louis criminal court, at its May term, 1886, on an indictment charging him with murder in the first degree, in killing one Charles Arthur Preller. He was convicted of the crime charged, and has appealed to this court from the judgment.
The record is very voluminous, and defendant’s counsel, with commendable zeal, have assigned a great number of alleged errors in the conduct of the trial, the first of which is that the court erred in overruling defendant’s motion to quash the indictment.
