ENGELHARDT, District Judge.

Plaintiff, Apex Oil Company, Inc., d/b/a Apex Towing Company (Apex), filed this suit appealing the denial of its claim for reimbursement of oil spill clean up costs under the Oil Pollution Act of 1990 (OPA), 33 U.S.C. §§ 2703, 2708(a)(1), as arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law. The matter is presently before this Court on cross-motions for summary judgment filed by Apex and the United States of Anerica (the Government).
